Can one litigate DTPA in small claims court?

It would depend on how the particular State set up the subject-matter jurisdiction of small-claims/justice courts. As the form did not list it, probably not in New York.

It was a close call. when I checked in they were over by 4

I've heard from a few that they won't start looking for volunteers until the flight is over by 7.

How retrograde. We do this all the time in KY and in that progressive state you can access all those sorts of forms online, usually as fill-in pdfs.

Just the breach. I didn't see a place for DTPA on the claim form.

I'm not really in this to completely eff them up. I just want my trip back.

It's not necessarily about effing them up. The statutory damages multiplier gives you added settlement leverage (though minimal in a case with such a low damages figure).

Also, a DTPA claim might afford you a cause of action that would not be subject to standard contract defenses.

I am guessing that this is *A flight, so it might be slightly O/T (course, this is teh Box :D), but one of the great things that happened over the last year with CO is the dramatic increase from not one mainline from any CO hub to CLT to several mainline flights a day to/from EWR and 1 mainline to/from IAH. I had the misfortune of flying IAH-CLT in a CRJ200 once. That was a l:rolleyes:ng ride!

I used to do IAH-CLT // CLT-IAH weekly, connecting to CLT-ROA, the  was strong... CR2s and ERJs get old after a while, especially when they're followed by a US Q200.

It's market and equipment dependent, I think. When I got bumped in CLE, they had overbooked an E135 by precisely two. A PClub agent in IAH told me that gate agents will not typically ask until there are ten overbooked, but that's IAH and she could have just wanted me to go away.

Yep. It was US. It's good to see more mainline into CLT. Now that I've experienced US F on several occasions and found it to be endurable, I'd actually consider IAH-CLT-HNL and IAH-CLT-GIG as redemption opportunities. The new angled-flat 767 hard product looks just fine, to me.

My MIA-IAH was over by five and they took three volunteers.

Weight, market, connections, etc. are all factors.

I've had the $200 offer come up on the kiosk for the last six flights. Come to find out, you can hit yes on that and then ask for more at the gate and still refuse the bump without losing your seat. ^

In retrospect it seems that there are forms online and such. I'm still learning. There's a website that charges $15 to do the online filing for NYC Small Claims. Considering that I had the time this morning and that the filing cost was only $20 to me I didn't mind the visit to the courthouse nor the pleasant walk over to my office afterwards.

Yes but you got to fly instead of going to work for 12 hours.

I think it depends on the market. I routinely got vouchers into and outta LBB with 1 or 2 oversold.

Good information to know as I like to get on the list as soon as possible. :)

I just heard from mnmag. There was an evacuation of the terminal in STL. She's out on the tarmac.

Oh, and not so much with getting the earlier flight home.
