Seriously there are only limited options for Hyatt, they can try to pay off the approved applicants and hope they bite or let it escalate. If the entry on the individuals credit report is permanent... Popcorn!!

Nobody seems to care about Hyatt anymore, even you burned all your points.

So I guess it is the Hilton Tokyo for you, at least as long as they hold a table in the club for you.

Which T&Cs are you referring to? The fine prints I received in the email clearly say
"3 Diamond status valid as long as your Hyatt Credit Card is open and not in default and you comply with Hyatt Gold Passport program rules. Authorized users will not be eligible for Diamond status or associated Diamond benefits."
I don't see a link pointing to any terms saying Platinum status.

2. Hyatt Gold Passport is not responsible for partner withdrawals from the program, changes in partner service or for Hyatt Gold Passport point cancellations caused by withdrawals.
3. The Hyatt Gold Passport program may continue until such time as Hyatt Gold Passport at its sole discretion elects to designate a program termination date. Hyatt Gold Passport has the right to end the Hyatt Gold Passport program by providing written notice to then Active Members six months in advance. An "Active Member" is a member that has received Hyatt Gold Passport points or Travel Partner miles or M life Tier Credits for a stay at a Hyatt hotel or resort within the preceding 12 months. A member's Hyatt Gold Passport membership may be discontinued at Hyatt Gold Passport's discretion if a member does not record Hyatt Gold Passport points, or Travel Partner miles or M life Tier Credits for a stay at a Hyatt hotel or resort activity during any consecutive 12-month period. All Hyatt Gold Passport points in the account will be forfeited at that time.
4. Hyatt Gold Passport may, without notice, discontinue Hyatt Gold Passport membership if a member fails to promptly pay hotel bills or appears to be utilizing the program in a manner inconsistent with these Terms and Conditions or the intent of the program, including, but not limited to, Hyatt Gold Passport point redemption and certificate use.
5. Hyatt Gold Passport may discontinue membership for any member who acts in an abusive manner or in a manner inconsistent with local, state or federal laws.
6. Discontinued membership will result in the loss of all accumulated Hyatt Gold Passport points and the Hyatt Gold Passport account will be closed.
7. The sale or barter of Hyatt Gold Passport points, hotel or partner awards or benefits other than by Hyatt Gold Passport is prohibited. Hyatt Gold Passport points, hotel or partner awards or benefits that have been transferred, sold or assigned for such purposes may be confiscated or canceled.
8. In the event that a hotel or resort ceases to operate as a Park Hyatt™, Andaz™, Grand Hyatt™, Hyatt Regency™, Hyatt™, Hyatt Place™, Hyatt House™, Hyatt Residence Club™ , or any other hotel brand owned, managed, operated, franchised or leased by Hyatt Corporation or its subsidiaries or affiliates, Hyatt Gold Passport points will not be awarded for stays at that property, nor will Hyatt Gold Passport points be available for redemption after the termination date at such property, even if the reservation was made prior to the termination date.
9. Accrued points do not constitute property of the Member. Hyatt Gold Passport points are for member's benefit only and are not transferable to another person for any reason including divorce or inheritance. In the case of documented death of a Hyatt Gold Passport member, Hyatt Gold Passport points are transferable to a person sharing the same residential mailing address.
10. Members must be at least 18 years of age and the age of majority in their state or province of residence. Individuals are only eligible to have one Hyatt Gold Passport membership. Memberships cannot be shared or combined by more than one person. Corporations, associations, or groups cannot enroll in Hyatt Gold Passport except in accordance with the Hyatt Gold Passport Planner Rewards™ program. Individuals working in Hyatt's corporate and divisional offices as well as individuals working at any Hyatt hotel or resort (collectively "Associates") may only participate in Hyatt Gold Passport while they are holders of a validly issued Hyatt Credit Card, the co-branded credit card issued by Chase that is available to U.S. residents only. Participation in Hyatt Gold Passport by Associates is governed by these terms as well as a separate set of terms available on HyattConnect or through your human resources director. Associates are otherwise not eligible to participate in Hyatt Gold Passport.

I got the follow up apology email and called to ask what they were going to do for me who signed up because of it. The agent was very apologetic, scrambled to read some notes on the issue to catch up, and opened a case which she will escalate. I assume others have done the same so the ball is in their court...

We just finished an event at a Hyatt worth a low 5 digit amount in Euro, so I really hope that they do not ask me for points or certs and give me a suite for free in the next couple of months.
Otherwise, we have to go back to Marriott

This has nothing to do with Chase or its withdrawal. It was Hyatt itself that promised the Diamond status for those who applied and were approved. It was Hyatt's offer (in its marketing email and on its website), not Chase's. It doesn't matter if Chase knew about this offer (or mistake). This offer was, nonetheless, Hyatt's, not a partner's, therefore this clause doesn't apply.
Its evident that Hyatt is not bound by its terms and conditions to honor what was wrongfully advertised. Otherwise there is a basis for a class action lawsuit.
This above is the distinct difference between the Fairmont Lifetime Platinum offer which Fairmont had to honor to avoid lawsuits, and which Hyatt is now denying on a legal basis. If Hyatt has no legal grounds to detract, then Hyatt would not risk going to court. The damages would be too costly.

I would agree if Hyatt issued its own credit cards, but Hyatt doesn't and their credit cards are administered through Chase. And there is the issue of applying for the credit card through Chase.
Its evident that Hyatt is not bound by its terms and conditions to honor what was wrongfully advertised. Otherwise there is a basis for a class action lawsuit.

However, Ancien Maestro is correct: You are dealing with Chase and not GP as far as the application and benefits go, as they are the "Partner" with the GP Program. Chase buys the benefits from GP in a sort of arms length transaction, so you cannot legally link the two entities and hold one partner responsible for the promises of the other.
My assessment is that you will get compensation of free nights or points, but no
Diamond status, since GP has never sold that, and Chase would have to buy that from them to compensate you.

In the short term, it would cost Hyatt less to give the advertised benefit, since virtually everybody that was eligible for the card was already going to be a Diamond until at least end of February 2014.

FYI.. When Fairmont President's Club ran into the same problem, Fairmont San Francisco marketing through Living Social a Penthouse Suite accompanied by 'permanent' FPC Platinum status, it was honored to the 115 some odd people who purchased this package. Those lucky enough to purchase the package received 'permanent' or 'lifetime' Platinum status.
Problem here though, is that the accompanying T&Cs state quite clearly 'Platinum' status, and that the T&Cs allows Hyatt the right to change the Terms and Conditions of whats offered here anytime.
I think legally, the party is over unfortunately.

There was a lot of drama that weekend but it was the pressure applied that got it honored. Ric Garido and I wrote about some of the behind the scenes on our sites.
I think the same lesson can be used here.

Ultimately you can establish a tag price for this 'Cardmembership-Lifetime' Diamond Status and sue for that amount as well.
I agree with hailstorm that T&C are not the ultimate authority when it comes to legal battle. There are more variables involved. I will stick to earlier assumption that Chase will not want to fight this endlessly and publicly. They would rather pay some money or move Hyatt to comply to make this go away.

The only winners I see in any legal action will be the lawyers. Hyatt's not going to honor lifetime Diamond. Even if they were 'forced' to honor it, I can almost guarantee that Chase will cancel the credit cards within a couple of years. And Chase can unilaterally cancel your credit card at any time without legal repercussions.
There were TONS of credit cards and lines of credit cancelled in 2009 by the banks so cancelling credit cards isn't virgin territory for Chase. If anyone here thinks that they'll get to keep the credit card AND get lifetime Diamond through the credit card, they're in for a rude awakening. http://online.wsj.com/news/articles/...43111012053966

I would think that the most lucrative method would be calculating the cost of obtaining/maintaining Diamond status. Assuming an average room rate of $200/night, the value of this benefit for this year would be the $200 multiplied by the lowest of number of stays/nights required to renew Diamond membership (possibly nothing for people that have already renewed), followed by $5000 (25 stays * 200/night) for every year thereafter where the Gold Passport member remains a Hyatt credit card holder.
I don't think that there would be a point equivalent that Hyatt could offer, as no amount of points could grant the cardholder Diamond status, nor impart on the cardholder the benefits of Diamond status.
