How happy will the judge be when he finds out the situation has been rectified?

But, INAL ;)

It would cost me $10 to file the claim in small claims court and then $50 or so to process the information request. This would be a small price to pay for internet infamy. The gaffes of the Chase reps are staggering. I kept a "mis-truth" tally and when I finally gave up keeping track, they had told me 27 "mis-truths."

I had one rep try and convince me that Manilla was actually in the US. And that wasn't even the epitome of .

I'll rephrase a movie line that may explain what they would do to you if you did post their stupidity. They'd marshal all the forces of darkness and hound you to an assisted suicide.

If they want to talk to me, they will hear the following phrase at the beginning of the call: due to pending legal action, I am recording this phone call.

Some were in the manual - some were listed on the Bolt browser website.

Was it anything like this? :D

Think about the back seat and front seat being full as well. The front seat was my personal mini fridge, though (water and lunch so I'm not tempted to walk to the PX).

Random question time --

I had a complete breakdown with Chase over the weekend and I'm considering the nuclear option and am trying to get copies of the phone calls, which they recorded. I think I can accomplish this by filing a small claims court action and then subpoenaing the recordings.

Unfortunately I have no real recourse against Chase as they've, after 3 days and about 12 hours on the phone, fixed their errors. My only desire to get these records and notes is to post them on the internet as they are truly spectacular.

Is that legal?

Any friendly box lawyers want to help me with this little "project?"

IANAL, but you need a live claim to take something to court. Courts don't give advisory opinions, and they don't mind sanctioning litigants who intentionally bring moot actions.

However, it may be that your experience with Chase gives rise to claims that you may not have considered (statutory or common-law). It sounds like you may have expended a considerable amount of time and effort in attempting to resolve these issues, due to their own malfeasance.

If it were me, I would try to consider what causes of action I might have, and what damages, if any, I had suffered. Did you use cell-phone minutes to rectify this situation, did resolution of this necessitate that you spend time that otherwise would have been spent working, did you suffer the loss of use (even if temporary) of any assets as a result? Those are the sorts of questions I would be asking, in addition to consulting your state's deceptive trade practices (and/or banking/credit practices) legislation...

Be sure to check any laws applicable to recording phone conversations before doing so. From what I understand, the law in this area is a confused mess, and it can be quite easy to run afoul of it. Just ask Linda Tripp.

I considered all that and I'm sure I could cobble together a $1,000 claim or so. I don't really care about that. I just want copies of the conversations. They are that astounding.

In other news, CO pulled a  one on me. (check the thread I just started)

There is entirely too much scrolling involved in Bolt posting...it's a nicer interface than the standard BB browser, but if I do this too much my trackball is going to go on strike.

I'm not a huge fan of Bolt. I prefer Opera's browser, which is faster and renders quite well. It also has super handy keyboard shortcuts to allow you to quick scroll around the page without using the trackball.

I'm posting from it now. :)

The next version of Opera Mini is also adding tabbed browsing and some other nice new features.

As long as you're upfront regarding recording the call it's no problem in NYS.

I haven't bothered to look up the answer in Texas, but have always wondered whether a company's statement that "this call may be recorded or monitored to improve customer assistance" would grant me the reciprocal right to record the conversation without making my own disclosure. I would suspect that it would, but am feeling too lazy to fire up Westlaw.

Hey Box. Early dinner tonight to end Yom Kippur. Two Pavel Kwak beers at our favorite Belgian mussels place and too much food for an empty stomach. ^^

Unplanned new FM line -- DTW-AUS, thanks to storms at IAH. We're on the ground at AUS now, and thanks to DL, my NW flight can't get to a gate and can't get ground air. This may get really interesting... We've already got a few ticked off passengers, and the crew is not happy with their new parent company's handling of the situation so far.
