It's been a while since I read my Constitution but I'm pretty sure the Dept. of Justice doesn't write the law. Congress has tried and failed to ban Internet gambling every year for over a decade. Even were they to do that, it would probably have to specifically include poker.

No they didn't.

You've posted a pointer to the Bill I mentioned that has been introduced and defeated every year. "Bill" is the term for proposed laws that have not yet been passed and signed into Law. After that they are called Acts.

Yes, the proposed law does not specify whether there can be any element of skill at all.

Poker is a game of skill and chance, like Bridge. It is not clear whether the proposed Bill would ban poker.

That was my original point. Under Ashcroft they made up their own law where none existed, to the point of seizing assets of a TV network for accepting advertising from an online site that operated legally in a foreign country.

Oh man, I'm gonna go home and download FullTiltPoker.com tonight and see how quickly I can get $ in my account. I'm in a weekly game most Wed nights (just a $21 buy-in), so we'll see how often I can play. Have never played on-line before. Btw, would there be interest in having an in person poker tourney? It would be like a FT gathering, except we'd play poker. Guess logistics would be the tricky part. See this thread.

The Justice Department has taken the position that online poker is illegal. That is why you can't use a US credit card to fund accounts on these sites. There are many news stories confirming this; however, one of the more insightful ones is in the NYTimes by Kurt Eichenwald (June 26, 2005). The article refers to a district court case (132 F.Supp.2d 468) and a 5th circuit case (313 F3d 257) holding that the use of a credit card to buy "chips" to use at an online casino didn't violate the wire act. (Well, I think that's what it held; I've just seen a summary of the case, not the whole thing.) This was a civil case in which those who had purchased the chips were trying to void themselves of the obligation to pay by suing Mastercard arguing that using a credit card violated RICO, and one of the alleged predicate acts was the Wire Act. An online company that recently went public/is going public is citing this 5th circuit case as the basis for telling its potential investors that online poker is legal and that Justice is wrong. I stand corrected - I never did memorize the tune from Conjunction Junction about how a Bill becomes law! :D

I agree that poker does require skill.

I don't really care that much, I just thought it was an interesting take by Komando...

A couple of weeks

You might not get it in time

There are other options, but you will have to pay a fee

Funding your FullTilt account is by far the worst part of the whole online poker experience...other than losing week after week, that is. :D

It took me about 8 days to get money from Netteller to FullTilt the free route. I think it can happen in 48 hours if you choose to pay to expedite it, but you're probably on the outside looking in for this week.
