I got an email that my no-fee Fidelity Rewards Visa has started this:

longtime Nexus member here - and dual US-Canadian citizen, US resident, and have both passports listed on my Nexus. Traveling to YYZ tomorrow, and just realized my Canadian passport expired in Oct (whoops…kicking myself for missing that!) obviously I’m going to get that renewed ASAP. But seems like Canadian government is ok with entering on valid US passport, though advises having proof of Canadian citizenship (I’ll carry recently expired Canadian passport for that). Question is if I’ll likely get flagged when entering if using Nexus kiosk or e-gate as it will have the recently expired passports listed, and obviously won’t be able to update it. If so, probably easier to go through the normal line (arriving from US at ~10:45pm, so expect the customs hall is on the quiet side). anyone have experience with this, or potential thoughts/insights? |

Your NEXUS isn't going to get revoked because one of your passports has expired. Your US passport is acceptable for a dual US / Canadian citizen to use to enter Canada. I'd use the NEXUS lane (with your NEXUS card) and apply for passport renewal ASAP. At present you have nothing to update with the NEXUS program as you don;t have a new passport. I don't see anything to worry ab:put.

I don’t know the answer but if you enter with a US passport, won’t you need an ETA? I’m a dual citizen and when I had my non-Canadian passport on my AC file, I couldn’t check in. Caused a huge to do. Took an experienced (and patient) agent almost an hour to fix. |

alright, so reporting back: short story short - went through e-gates like normal, showed officer the receipt and asked no questions. So basically, just normal.
i have filled out passport renewal app though - getting photos tomorrow and handing in on Friday. That’ll be done.

no ETA for Americans - think they are the only ones that are exempt. In fact, I believe if the dual citizenship is with any other country, what I did wouldn’t work since all other foreign citizens require ETA, and Canadians can not get one. |

What would be the answer for the below question which is being asked while filling the application. Have you ever been found in violation of customs or immigration laws or other federal import laws? I know I havent violated any but the ? near this says the following wording which is a bit confusing "A customs violation could be failing to declare goods or merchandise, or bringing in prohibited goods etc. An immigration violation could be any immigration document issues, refusal into United States etc. not all violations are disqualifying but should be noted. " |

Based on what you described, there was no immigration violation unless you stayed beyond the original visa.

Being denied a visa renewal is not an immigration violation. Staying past whatever period the visa was valid for is. So the real factors here are when your visa expired and when you left. Based on what y:Du wrote, if you did not overstay then you do not have any violations.

I was under implied status (while waiting for my renewal decision). By the time the decision came I was like a week over my I94 date but left the country in a couple of days. This was the timeline for reference.
