Best rate guarantee - successes and failures 2008 on [Master Thread]

I'm curious to know how that worked out at the Westin Las Vegas. Cheapostay.com's rate there for tonight is $89++ -- the same base rate on spg.com. But cheapostay's rate tonight is technically sort of a package rate because it adds the following:
$15 Booking Credit
FREE Parking

And whereas the total taxes and service fees via spg.com adds $21.32, the total of taxes and fees via cheapostay.com is a whopping $45.12! Even after the $15 booking credit is subtracted, the total cost is still $8.80 more than the total on spg.com. And there's no word on whether this includes this hotel's controversial service fee unless the "free parking" statement is meant to say that it does.

String of one nighters

Is it possible to file 2 claims (one for each day) for consecutive nights at the same property?
Example:
Book a sheraton for one night on a consecutive Thurs, Fri, Sat, and Sun, and recieve 8000 points for 4 seperate BRGs?

The Best Rate Guarantee program guarantees that we have the lowest rates on our websites. If the rates are exactly the same and the competing website's cancel policy is better, then the claim can be approved. However, if the cancel policy on our website is better, your claim will be denied.
The terms and conditions state that the claim can be approved if '... the Competing Rate is lower than any available Starwood Rate...' If the competing rate is not lower than any available rate, your claim can not be approved.
The Best Rate Guarantee is not a best cancel policy guarantee.

My confusion arises from the fact that the denial was based upon the following language in the program terms and conditions. (emphasis on starwoods 'extract')

Rate Limitations
The Best Rate Guarantee applies to a Competing Rate with rate limitations that are substantially similar to the rate limitations of the rate that can be booked on a Starwood-branded Website (the "Starwood Rate"). Rate limitations include, but are not limited to, advance purchase requirements ,prepayment and deposit requirements, and cancellation and change policies. If there is no Starwood Rate available that has substantially similar rate rules to that of the Competing Rate, and the Competing Rate is lower than anyavailable Starwood Rate, Starwood, in its sole discretion, may honor the Competing Rate with the applicable Starwood Rate Limitations, room type, and amenities plus a Best Rate Guarantee Reward, provided it meets all other Terms and Conditions.
However, This phrase comes within the statement " If there is no Starwood Rate available that has substantially similar rate rules to that of the Competing Rate, and the Competing Rate is lower than any available Starwood Rate, Starwood, in its sole discretion...."

I applied for BRG based upon the existence of a flexible rate (BAR) on SPG of 6400 baht and a flexible competitor rate of 3200 baht. This was denied on the basis that the cheapest available rate (NOT flexible) on SPG was 3200 and so the claim was denied.

From the language of the T's&C's above it seems clear that the 'Starwood Rate' used should be 'substantially similar' in its conditions IF such a rate is available. - which is precisely the opposite of the interpretation put on it by the BRG team in their reply to me.

Has anyone queried this previously with the BRG team - the 'extract' from the T's & C's they quote when denying claims seems to (if not selectively extracted) be precisely the reason why the claim must be approved?

Also, just wondering what the legal status of a published guarantee like this is? - can SPG be forced to abide by their own published terms and conditions or if legally challenged could they simply declare the entire 'guarantee' an optional benefit (i.e. is it actually a guarantee or simply a 'consumer friendly policy' with no legal effect)?

If this (now unfortunately standard, it would appear) policy of "deny any/all BRG's where the lowest available rate on SPG.com, (no matter how restricted) is lower than the competitor rate" is the standard to be applied, then SPG should redraft their T's &C's to actually state that ?... as I read them they currently do not.

Just got back late Saturday night and it worked out fine. I actually asked the rep to confirm everything for me including the price...he came back with the price written on my room card packet. I paid $79.00 + change / night on the Tues / Wed. We were their also on the weekend then left for a couple of days to play some golf in Utah. The weekend stays were simply booked through SPG as it was very busy with a full house over the weekend.

........all o.k. unless I see something different on my credit card statement

Coincidentally, it's the same situation with the Westin Nova Scotian for these same dates. The price on Hotels.ca matches that of the Book Now and Save rate at SPG.com, but the Hotels.ca reservation will let you cancel up to the day prior to arrival.

I queried this on the basis that the language on the website simply did not justify the current policy - and received a mail today from the BRG team stating that the supervisor had authorised accepting my claim ^

Just thought I should pass this on ... depending on whether this represents a shift in policy it could be useful for others to know - it might be worth 'pushing back' on some of the refusals, particularly any that rely on the 'cheapest rate' being on SPG even if it's wildly different in its restrictions from the competing rate.
