You have a week or so before the card arrives. Call in and get it straightened out. You dont have any activity on it yet for them to really analyze. Plus, you risk further grief when you start using the card and they realize the issue later and the funds are no longer on the card and they approach the card owner (not you).

As it appears you are from LAS, the choice is clear. Cash out your chips and walk! :D

Seriously, I've heard of banks going after people who have done that!

Seriously, take the money. If they ask for it back, ask them to document. very likely they will give up.

2) the card isnt under his SSN so that can cause trouble for whoever it is under.

Yeah, demand they provide a copy of their DL and SS card and then stonewall them for 2 weeks.

Yes, it is considered Larceny - take out the money deposited in your account due to bank error and that you know it does not belong to you.
You can google this kind of situation and find out more.

I know we dont like what InComm has done to our accounts, and they are holding the money from many of us. Unfortunately the regulations do allow such to certain degree (pending investigation before account closure, and funds returned to the rightful owners, blah blah blah.)

The customer though, could not take out money not belongs to the customer without bad effect.

Then tell them to call back if nothing has been resolved by the date you told them it would be resolved.

according to FBI definition, it is not larceny.
if someone put some money in your pocket, you probably can spend it.

I personally got extra $500 when I tried to load moneypak into amex prepaid a while ago.

the right thing to do is "don't ask, don't tell".

if they realize it and take it back, fine. if not, keep it.

I called MVD today, a good 10 days after submitting my DL and SSN. I was put on hold several times and for about 20 mins total. Result was nothing...an email has been sent to have somebody look into my account and call me back. I was told if I don't receive a call back tomorrow, to call them. Guess I'll call tomorrow and see what happens.
