Basically due to the duty hours, the crew need to have a layover in Tripoli. Since Tripoli is not a safe destination and has been issued Travel Warnings against all but essential travel to Libya, the flight is routed via Malta for the time being, and the crew layover in MLA. On the return sector a new set of crew board in MLA and operate MLA-TIP-DXB.

DXB-JFK-MEX cannot pickup passengers for the JFK-MEX leg due to Mexico-U.S. bilateral agreement. Its fairly strict - Two carriers from each nation on business/VFR routes (MEX, GDL, MLM) and three on the tourist routes (CUN PVR etc). There's no way in hell a gulf carrier gets traffic rights on it at this time.

As ridiculous as the routing is they could fly the route assuming it meets any EU-Mexico arrangement and any UAE-Mexico agreement. EK just cannot carry passengers solely between US-Mexico.
It would be similar to the set up Qantas has flying SYD-LAX-JFK. They cannot carry people between LAX and JFK.

It still seems unlikely though. The route is still operated by a 77L, so a 388 would be a 'double-upgauge', so to speak. Plus trunk Indian routes have come in sideways on the 388 wait-list for this year (the Hyderabad airshow next week would be a well-timed announcement), so they're not going to have the luxury of many spare airframes.
