Nope. Usually the cops are indemnified by the agency/political unit that employs him. It takes a special ruling from the judge for that indemnity to go away, and for that to occur it has to be demonstrated that the officer acted outside of agency policy.

(Some police unions have a special fund to draw on in that event. And in some areas there is a shared risk pool so that the pain is distributed over the entire state, West Virginia is a prime example.)

That was the case in the accident I referred to earlier. The jury awarded $15K, and some of the jury worried that it was too high because the cop had a wife and new baby. That's a steaming load of bovine fecal matter. Cop should have thought about his wife and kid before he slapped the cuffs on a firefighter at an accident scene. Hand him $50K and then watch his wife make him sleep on the couch for a year.

Looking at the court's website, it shows a trial date of December 7. Hopefully it won't be delayed again and we can make some progress in the courts against the TSA's ID policies.

I understand that defense can ask for continuances but this is a pretty minor case and its going on a year.

Bogging down the court systems harms the justice system.

Have the trial, reach a verdict and move on.
