I sometimes move up to E+ and it's equivalents when there are empty seats there. I only do it when I'm flying from A to B but when I've bought a cheaper A to B to C ticket. When I switch seats, I make sure put carry on in the F cabin on the way back to Y. It just fits in there better sideways and it's easier to pick up on the way out of the plane. I just find it easier in E+ to get my laptop out and write fake Trip Adviser reviews or watch a movie without headphones.

Hmmm, that's a good question. In all honesty, I'm not sure. I have had someone move from E to E+ but I was sitting at the window seat and she moved to the aisle seat (and she was 70+). So I'll go by that example, if she moved next to me instead of the aisle, then no I wouldn't have a problem with it.

Whilst I agree absolutely with the sentiment that it shouldn't be done, "theft of service" made me laugh. Nowadays there is no service on US airlines. The only think that has been stolen is the expectation of service, and it's the airline that has stolen that expectation.

I'm a thief?
Not so much. Career cop here, theft charges would never stick in either case.
If the FA told you to move and you didn't, you have much larger problems with the federal crime of interference with a flight crew.

Ok then. On UA, E+ middle seats are $10-$20 cheaper than aisle or window. So, I buy the middle seat and the guy in the window doesn't show, and I move to the open window seat.
