ETA: On top of that, many card issuers are able to identify MS-type activity based on amounts and other transactions made by the customer. For instance, spending in the hundreds of dollars at places like CVS constantly is a red-flag, spending in increments of $505.95 is a dead give-away even if they're not getting Level 3 data.

Is that legal for a store to pass your detail purchase activities on to the bank? Or is that agreement to give away your privacy buried in the credit card T&Cs somewhere when you sign up?

When you use your credit card at a merchant, you're generally agreeing to several different companies getting some information about you, because they need it to process the transaction correctly. For instance, the store gets your name when you use a credit card, whether you give them your name or not. The merchant processor, who you have no relationship with gets certain information about you in order to process the transactions.
You probably are agreeing to let a card issuer obtain information about you and your purchase from a merchant (either implicitly and/or explicitly) and to use this information for a variety of purposes. One purpose is to administer your account and comply with federal law. For example, if you dispute a transaction, unless the issuer wants to take a loss, they are required to contact the merchant and obtain details on the transaction in order to make a decision. The merchant has to be allowed to make their case to the card issuer, and the only way to do that is to provide proof that they complied with their obligations under their agreement with the customer and/or that they complied with their obligations under their agreement with the processor.
What the credit card company can then do with the information is governed by federal law (the GLBA and some other laws), and to a lesser extent its contract with the customer. Some issuers will sell your "anonymized" data to other companies (I put anonymized in quotes because with a very minimal amount of information companies can discover who you are).

FWIW, I just spoke to amex this morning and they show my total spend correctly, but cant explain delta showing less. The agent i spoke with said shes going to talk with their DL contact during the week on Tuesday to find out if theres any known issues right now and get back to me. So Amex isnt doing anything to the numbers, which means its far more likely a technical issue somewhere in the pipeline.

Just ran the numbers and here's my own data points for year to date:
$117k - Total spend on two Delta cards
$43k - MQD's shown on Delta
$74k - Missing MQD's on Delta
$74k - MS spend at SM
Missing MQD's = MS spend at SM
This looks like a pretty strong data point that SM spend is being skimmed off the MQD's. MS spend from GC.com and GCM.com is reported fine in the MQDs. I will continue to monitor (does not appear to be related to statement closing dates since this is year to date spending over multiple statements). I'm not calling AMEX or Delta at this point since I don't want eyes on accounts.

Someone please educate me as to what “MS” and the “other” “SM” is (I.e. not Sky Miles). Are we talking “Manufactured Spend”? Isn’t “Manufactured Spend” just charging stuff to your card?

Why does it matter? How can DL unilaterally exclude $74K in purchases? As far as I can tell, none of my purchases have been excluded (reached $250K last month, not that it mattered).

Where are you seeing your DL AmEx spend to date? Mine dropped off delta.dumb this year when I passed the $25,000 mark, even though earlier it was showing the bar graph for $250,000.
The last time I called AmEx to ask, the call center person just recited the amount printed on my most recent statement and then was confused when I asked more specifically for the current number.

My own experience with them is via some lucrative casino promotions ~10+ years ago where the promotional giveaways/prizes were distributed via VISA gift cards which were issued by "Simon Mall". I'm assuming in an MS context something like this is implied.
More broadly they seem to be a gigantic real estate management/holding company that includes actual physical malls

They own and operate some upscale malls and also some outlet malls in various USA locations. At least in the upscale malls, they seem to be stressing their brand as well as providing amenities such as wifi, concierge services, and some nice seating areas.

Where are you seeing your DL AmEx spend to date? Mine dropped off delta.dumb this year when I passed the $25,000 mark, even though earlier it was showing the bar graph for $250,000.

It just says that my card spend is $25K+ as of June 15th and tyhe bottom bar graph is totally green. It doesn't give any more information that I can find.
