Question for the attorneys of the box:

The situation:

We are scheduled to close on the condo tomorrow. I just got a call from my RE agent saying there was just a Lis pendens issued for mechanical work. Now that there is a lean we cant close. We have been delayed 3 weeks now becuase of the builder slacking off and not finishing things. Our lease on our current place is up on the 28th and someone is moving in on the 1st.

Question:

What recourse do we have to make the sellers pay for living expenses until they clear the Lis pendens and we are able to close? Ive been told the sellers are basically broke and the RE agent is even paying to have the place professionally cleaned before closing because thats what it takes to make me happy.

At this point Im about ready to back out of the whole deal but am concerned about getting the $21k I put in escrow to secure the place and all the mortgage, inspection fees (probably around a grand) Ive paid back too?
