Sir, that is an ILLEGAL device"....I said "Your NUTS....It is my device I paid for. I own it and can do anything I damn well please with it".....he then said "Sir, the device you have IS illegal....I must now ask you to turn over the ILLEGAL device at once". I responded and said "Dude, your nuts, it is not illegal and if you think I am giving it to you, I have a bridge in the sahara desert I'd like to sell you"....he then said "sir, if you refuse to turn over your ILLEGAL device I must have a copy of your drivers license"......I said " Dude, you really are nuts..your not taking my itouch and you have no right to ask for my DL"..he then said I had to either give him my itouch or my DL or he will contact security...LOL..Oh boy..the MALL POLICE!!!.....I told him "go right ahead..I'll make myself comfy and wait".....Instead of the MALL POLICE..and actual Police Officer came....

Is there something in the small print that says you don't own it then?

I would have just given the Apple employee the finger in a rather rude and loud way, and then left the store. If the Apple employee tries to detain you then happily wait until the real police show up-- you should then be able to file false arrest charges against the employee.

When people tell me that I can't do what I want with a device that I own, I have no problem getting rude-- and physical, if necessary-- with them.

I'm not sure about the fine print actually stating this, but from a pure attitude position, both Apple and ATT are essentially saying that you do not own the device, but rather are 'leasing it' under license from Apple. Not even sure if it would be legal to enforce, especially if you pay full retail for the phone or still own it past the 2yr contract period.

I would be interested what experienced travellers here say. In some jurisdiction, its considered attempting to obtain financial benefit/money/object by deception.

Apple has said they believe it's illegal to jailbreak an iPhone or iTouch

The Electronic Frontier Foundation has posted the news that Apple has filed comments with the US Copyright Office stating that the act of jailbreaking your iPhone is a copyright infringement and a DMCA violation, and therefore illegal. The EFF says that Apple is claiming that jailbreak apps still require modified versions of Apple's software, and Apple apparently believes that those versions are infringing on their copyrights.

But that most certainly needs to be tested in the courts before store employees can take the device from you. Assuming the story is true, it's a mall cop wannabe who was working the counter there.

okay, someone please explain why it's necessary to JB the iPod Touch? I know why people do it to iPhone, but iPod Touch?

by the way, if Apple really considers a jailbroken iPhone or iPod Touch to be "illegal" and in violation of copyright/DMCA laws....
can Apple send a memo to the Depatment of Homeland Security? Next time you go through customs check at your
friendly airport, the CBP agent can seize/confiscate your iPhone/iPod Touch because it's illegal?

They jailbreak them so they can run applications other then the official apple approved ones.

You can add stuff that developers have come up with but don't meet Apple's standards and Apple won't let them sell on the App Store or don't want to abide by apple's pricing scheme.

jailbreaking voids the warranty, so they could at most, deny any repairs. from the article, he wasn't bringing it in for a repair, so that's moot. it's not illegal to jailbreak it. someone was on a power trip.

I agree apple went overboard.

But WHY would someone bring a hacked phone or iTouch an apple store. That's like asking Microsoft to help with a pirated MS Office bought in China....stupid move!

That depends - if there is a hardware issue you still need Apple to fix it. But I'd think that you'd be best off to restore it to pre-jailbreak status before handing it over to them...

Except, in one instance, you stole the product, and in the other, you paid for it.
