I'm not sure about the fine print actually stating this, but from a pure attitude position, both Apple and ATT are essentially saying that you do not own the device, but rather are 'leasing it' under license from Apple. Not even sure if it would be legal to enforce, especially if you pay full retail for the phone or still own it past the 2yr contract period.
