Dr. HFH, is this concept of "unilateral mistake" only a phenomenon of German (or Austrian / Swiss law) or is it also a concept of English common law? If the former only, then would it have any relevance to a CMB-DFW fare purchased by an US resident and paid with a US CC?

PS. I presume (and please correct me if I am wrong), your legal qualifications have Germanic origins?

Have anyone received such statement in writing from EY? WHen I spoke w/EY she quickly (and arrogantly) said "ma'am you are welcome to pay the fare difference if you want access to lounge, limo, etc"- I wanted to scream at her but thought it'd be a waste of time. I did tell her that EY needed to honor all the perks that came with F class- no exception. She kept saying, fare was coded wrong, so we reserve the right to modify the amenities. What the heck does that even mean?

So at this point it'd be useless for me to file complaint with DOT since it's verbal he says she says?

What do you plan on writing/sending to the DOT about this unacceptable craziness? This whole thing is ridiculous...

Im flying EY Diamond First AUH-NYC for $961 on EY metal (not jet airways), regardless of anything else. This makes me happy. The End.

I am going to make it up on the plane for the no lounge access. With 15 hrs ahead, a lot of good and premium drinks will go bust.

When you mention 9W, im hoping that you mean that EY103 is now operated by EY on EY metal until further notice? I am having difficulties finding official press release of the plans of EY103.

Would do the same if the standard F food and drinks are loaded but what are the odds of them loading a sub standard catering because of us?

I am hoping that those who have filed with DOT can report back any official statements from EY.

I myself have not called or received any communications from EY other than my confirmation email from PL.

I strongly believe they cannot go that low. But if they do that, then they will definitely make it in the news, in not such great way. That's for sure.

As stated previously, if EY is petty enough to lower their service standard on the ground by denying lounge access, it's entirely possible they'll deny you those "good and premium drinks" once onboard as well.

yeah... My wife has already said that she wants me to cancel She was excited about the idea but she said she would prefer flying Y rather than having someone look at her like a thief for 15 hours.

I have negotiated to wait another month, just to see how the situation develops

It would be good PR if they handle this well but from what's going on, it would just seem otherwise.

However, I believe nothing is final yet so fingers crossed.

Any news on the 9W operated 77W EY103?

I don't think there's been any word from EY or 9W since the FAA downgraded India to Category 2.

Despite that Category 2 status, it's still possible we'll see 9W metal on EY102/EY103. Other airlines have used similar wet leases to circumvent Category 2 restrictions before: http://www.philstar.com/business/201...-skirt-faa-ban
