NYC96 sez:We were especially intrigued by the sentence stating that FAA policy requires passengers to use the restroom in their seating class. We emailed the FAA to find out whether that’s true, and it doesn’t seem to be.

FAA spokeswoman Alison Duquette wrote back, “that is not part of any FAA safety regulation. That’s airline policy and they probably base it on a TSA security regulation that prohibits people from congregating in one spot.” We asked Delta to find out whether that is the carrier’s actual policy and will update this item when we hear.

But David Castelveter, spokesman for the Air Transport Association, a commercial aviation trade group, told us in an e-mail that he is “not aware of it being a Federal rule/law/policy. Most carriers do reserve the respective restroom(s) for the passenger traveling in that cabin, i.e., first-class passengers have a first-class cabin restroom. Cabin crews, however, reserve the right to waive those rules if deemed necessary and/or appropriate.”

UPDATE: Delta spokesman Kent Landers just wrote us, saying “Delta follows regulations that limit lavatory use to the customer’s class of service on any international flight operating into the United States. This is tied to a TSA security directive
