Customs clearance in CPH

Hi all,

I thought I place it here since there are a lot of CPH regulars in this forum.

I will return from the US and need to declare something at the customs to pay the Swedish(!) VAT. My tax accountant said I should tell the Danish customs officers that I'm headed to Sweden will apply for the Swedish VAT (MOMS).

I'm just not sure:
1) Do I pay the Swedish VAT to the Danish customs?
or
2) Are there Swedish customs officers in CPH
or
3) I just leave CPH airport, head to Sweden and then look for customs e.g. in Malm (no idea where I would find them if I arrive by train - would know by car as it is obvious )

Any idea?

Swedish customs has a phone and office at Hyllie. You're supposed to call them if you have questions or need to make a declaration upon crossing via train from CPH to Sweden.

No Swedish Tull personnel working passenger-facing roles at CPH when I'm there, but they have been known to be called up from CPH.

Can't speak to the ability of Danish customs to make Swedish tax determinations. I can barely get Swedish tax authorities to make consistent Swedish tax determinations, but at least the Danish customs won't have to do that themselves.

Danish Skat should have an idea, so may be best to call them up. Several years ago rules were changed in some way when it came to temporary importation.

Is the item such that it would get you in trouble if you didn't report and import it or are you simply importing items over the non-taxed financial threshold?

In the first case, I'd report it to Danish customs and get it registered then drive to Sweden make the judgement call again.

In the second case I'd take the gamble and pretend innocence where you to be checked.

Probably won't get into much trouble if I do not declare it in Denmark, it is just a computer which I buy for my company. In order to claim the money back from my company I will need to have a 'lawful' import and not just carry it over :/

Pretty silly considering I pay like 500 MOMS and get it back like at the end of the quarter.

Aren't you supposed to pay the import fees at the first point of entry in the EU? Once it is within EU, you can move it around freely as you wish.
That is at least my understanding from a previous job where we used to carry expensive things around with us across the globe.

There are no import fees for computers, just the VAT.

Anyway, it was also my understanding that I would need to declare the goods at the point of entry but my tax adviser talked to the customs and they told him I should declare it with Swedish customs as my company is registered in Sweden and will reclaim the Swedish VAT. Probably there is some cooperation between Sweden and Denmark since CPH serves the metropolitan area of Copenhagen and Malm?

I know there are some quite funny agreements on taxes and social security here as well... I will talk to the Danish customs on my outbound flight to get their input and hope the customs officers are not totally clueless - which I think they will be

SKAT answers the phone, but just make sure to budget around at least 30 minutes to get in touch. They seemed more willing to look things up on the computers while over the phone than Danish customs at CPH this morning.

Thanks, will call SKAT then and ask for their opinion. The whole thing is just a huge inconvenience. I wonder what would happen if I just send in the receipt to my company without VAT paid...?

Nothing should happen, they would normally require the receipts to reclaim VAT that they reimbursed you for, but if that wasn't paid in the first place there shouldn't be a problem. It should in fact be easier for your company's finance department.

That would be actually nice. It is my company (one of those famous one person Aktiebolag-things - just started... ) and I will need to run my expenses to my tax accountant. I will talk to him if I can claim back the money from my company paid with my own private credit card.

Any hints where I could read some solid rule up for that scenario?

It would just be a personal expense, your accountant can deal with it for the company and you add it to your personal declaration when the time comes. If there is no VAT to reclaim your accountant doesn't have to worry about it, similar to a business to business transaction where it is not applied.

Should really get the facts from your two preferred financial advisors and not a forum for frequent flyers.

European Commission: VAT
imports: VAT is levied on the importation of goods and usually charged when customs clearance procedures take place in order to be released for circulation. However, when the goods are imported into one EU country but are intended for use or consumption in another, they can be placed under a VAT suspensive arrangement. Under this arrangement, VAT will be charged in the EU country of destination and not in the EU country of entrance in the EU.
I just wonder who decides what is placed under that arrangement.

Yea, maybe I didn't type properly, what I meant was customs fees, VAT etc, that are due because of the import of the item.

Interesting to see that text about VAT suspension, haven't heard of that before. Think I need to look it up, could be useful in the future...

Thanks Jainzar, that is quite helpful. Since the good will indeed primary used in Sweden it then makes sense to pay VAT there and also reclaim it.
