Emirates complaint advice please........
Hello just hoping for some advice from anyone who might have been through something similar with Emirates.
My wife and I, plus 3 children, recently flew Emirates on business class which we did via a points/rewards redemption for 300K miles. (i.e. c60K Skymiles each).
My daughter suffers from celiac disease so we specified we needed a gluten free meal.
They provided this, however after her meal they gave her a normal dessert which was not gluten free, which made her very ill.
The flight crew organised an ambulance to meet her when the plane pulled into the gate, and she was taken to the hospital area at the airport for help. They also admitted they had made an error by giving her the dessert, and it did contain gluten.
All up she was there for 3 hours at least, throwing up continuously while we all waited, missed our ground transfers, dinner bookings for my birthday, etc. until she was OK enough to leave the airport medical facility and for us to head to our hotel.
After the incident, throughout our holiday and even now, she is petrified of eating gluten again by mistake, throwing up, etc. she really has suffered from the aftermath of the ordeal for a 10 year old. The gluten would not be good for her stomach, and we are told will take some time to work through.
After writing to Emirates about what happened, they offered us 25,000 miles and to sign a release, without any omission of error, etc.
Does anyone have any view on this, i.e. is the 25K miles fair offer under the circumstances and/or what might be standard and fair from any past experience with Emirates similar to this one for us ????

In business class there is always a choice of dessert - presumably the adults that were with her were consulted on her choice. I think the responsibility rests with the adult that supervised her choice rather than with the cabin crew. Presumably she was provided with a suitable main meal? I don't think that 25k miles is a bad offer in the circumstances.

From my experience the amount of miles I have been compensated seemed to reflect my status at the time rather than the reason for the compensation.
I don't think the cabin class you flew should have any bearing in this instance. Did you check the dessert your daughter was offered? Did you ask the crew if the item was gluten free when they gave it to her?

Firstly I am sorry to hear about your daughter and her experiance, definatly not what anyone wants to hear about and mistakes do happen but they can be deadly.
So what you have is a claim for compensation for injury and it's assumed Emirates accept liability in this case (it's hard not to). If it was a Personal Injury Claim in the UK against a restaurant, you would expect it to fit under the minor injuries in the sense full recovery within 7 day's and therefore it would have an award of a few hundred pounds so at most 500.
EK's proposal is 25,000 Miles which if you were to buy it seems they would cost 587 however if you were to redeem, Im sure you would get poor value. Unless your planning on using them towards a flight, I would personally reply, I note your offer of 25K Miles, I would ask you to provide the cash value of the points as points are no use to a 10 year old child.
