It sounds like the passenger already physically had a bagtag with the other passenger's PNR and name which would give them access to all that already. Not saying that's what they did but the airport agent didn't actually give them any additional access. Also.... not saying this is a good situation....

Albeit the error here was not by the baggage handlers, but instead by the check in agent incorrectly tagging a bag.

Update

For anyone interersted an update. Had a call and email from BA Indian call centre. The caller seemed to have no grasp as to what has happened and seems to think I have the case, and can I give him the number on the baggage label, after four days in Spain, and i am eating in a restaurant. He did not listen to me or my explanations. I sent an email very strongly worded with a sentence by sentence explanation. I received a reply that it has been escalated to his superiors. MSM 2000uk who is acting for his friend in India has updated me with the info that his friends case has a tracking device and is still in Malaga. I jested it would be quicker to send an elephant for the case. I feel there is a comedy sketch here somewhere.

So the bag finally arrived - 7 days later than planned.

I sense the compensation issue is going to take a while to sort too!
