BA's unlawful 0844 numbers

The one thing that's unambiguous is that BA isn't following the guidance (correct as you are that they don't have to).

As for the regs remaining ambiguous until tested in court, you could make that argument for any reg or piece of legislation! But it's not the way many businesses would want to conduct themselves.
We'll have to agree to disagree on that. These Regs are poorly drafted hence the wide interpretation, the government will either have to amend the Regs for clarity or wait for the courts to provide the necessary clarification.

0800 can be 20p a minute or more from mobiles. Free on giffgaff and on new 3 tariffs though.

Is 0800 standard rate from mobiles? I don't think it counts towards my inclusive minutes.

Yes I've seen that Silver etc have an alternative non 08# but nothing for Gold oddly enough...

Had to have a check myself, on Vodafone only 01,02 and 03 are included in inclusive minutes and 0800 charged 15p minute. My mistake.
I tend to use mainly when sorting travel bookings as either at office or home, if on road normally online sorting, so never even considered this.

Strangely 080 numbers are likely to fall foul of these Regs.

I use Skype - 0800 UK numbers are free to call. Even 3G gives enough bandwidth for voice calls via Skype.

So essentially you place no weight in the fact that many other businesses seem to have no issue with the clarity of the regulations and have issued new contact numbers in the 01-03 range?

That's correct, I place no weight whatever on what other businesses do when interpreting law or advising a client. You cannot blame BA (or any other business) for the poor drafting of Regulations.

The adequacy of the drafting of the Regulations is your opinion.

My point was that many businesses have a clearly stated risk appetite not to get into a situation whereby they are taking an aggressive position in relation to their peers on a legal matter, unless they felt they had a nailed-on case (e.g. two separate counsels opinions strongly supporting their chance of victory if tested in court). Thats what I mean by risk aversity.
