//Clarified : This is a hypothetical question that has arisen from a real world experience. If the premise is taken at face value, would one run afoul of the rules. (One entry in the thread clarified it for me, get a ruling from AA first). I've never pondered it before as I have never before seen U without C space until now)//
Is this considered inventory tampering ? As EXP You have purchased an international y. You apply SWU and wait list. Subsequently AA opens up saver business (u) but not SWU upgrade space (C). You take the U seat with your miles inviting a friend to go. The friend can't go and you refund the U space much closer to the travel date.

Ultimately, the only opinion that matters is that of AA.

i have no idea. Butt if it happened it would put inventory back in business class for whatever purpose AA deemed appropriate.

It all depends on what AA believes your intent was. People, of course, book and cancel tickets all the time. That is why people book refundable tickets.
But, at the time of the booking, you (or the person for whom you book) must have the intent to fly. And the judge of intent is solely AA.
Easy translation: don't attempt this more than once in a great long while. If you must do it again, I would call AA and specifically request the authorization discussed in the COC.

And be aware AA Corporate Security is very canny, reads here and has put some hurt on some FTers and others for playing with the CofC. Doing it once might slide by, but how much tolerance of risk do you have?

my intent is pure. like many EXPs I grab award inventory all the time on chances I may use it (if its within say a 50% probability)

this isn't something I'm doing, just asking hypotheticals. I started thinking what if this really did happen, would it be a violation ?. while I think AA is screwing with upgrades by selling out EXPs with SWUs by offering general members saver awards, I wouldnt trust AA for one second as they would love to totally f over an EXPs by saying oh so sorry well just take those 13 SWUs and 800,000 miles. think how happy they would be to so easily rid of those obligations.

No different than booking F seats on Full F fare and refunding right before departure so that your upgrade clears.
