Do I need a transit visa for Paris?

I am travelling to Mumbai via Paris. Do I need a transit visa. My current US visa has expired but I have a valid Indian Passport. The reason I ask is that this particular website http://www.consulfrance-chicago.org/...t-transit-visa specifically says that for an expired US visa we don't need a transit visa.

You didn't say where you are travelling from.

If you have a US visa which has just expired and you are travelling from the USA back to India, because you have just used the visa and you are now returning, then you don't need a visa to transit Paris - provided that if you are transiting CDG airport there are less than 24 hours between your flights, or if you are transiting ORY airport the flights are in the same terminal and on the same calendar day.

If you are not travelling from the USA, then you do need a transit visa.

If the reason you only have an expired US visa is because you overstayed in the US, then I am not entirely sure but I believe you would need a transit visa, which may be denied since you have already demonstrated non-compliance with the terms of your US visa. Although airline agents in the US may not necessarily notice your US visa expired some time ago and allow you to board anyway, and checks in France are unlikely although may still happen and they will just send you to India which is where you want to go anyway.

I am flying from USA. My US visa has expired 4 years ago but I am legally allowed to stay in the USA since I have a valid i-797. Visa only lets you enter the nation but the I-797 determines how long you can stay in the country. So I am wondering if people are confusing visa expiry with illegal stay since I am getting conflicting information from different sources.

The page you linked to in the OP clearly indicates that you do NOT need a transit visa.

"You DO NOT NEED an airport transit visa if you hold an expired visa for the European Union, Iceland, Liechtenstein, Norway, Switzerland, Monaco, Andorra, San Marino, Canada, Japan or the United States of America but you are leaving the country which delivered it (for e.g., if you are an Indian citizen holding an expired US visa and flying to Dubai via Paris, and if you do not plan to leave the international zone of the airport, you do not need to apply for a Schengen visa of any kind);"


Also, Timatic (software used by airlines) is also in agreement.

France - Transit Visa

Transiting without a visa is possible for:

Holders of onward tickets in transit provided holding a valid visa issued by Bulgaria, Canada, Croatia, Cyprus, Ireland (Rep.), Japan, Romania, USA or United Kingdom, traveling to any non-Schengen Member State; or
- returning from Bulgaria, Canada, Croatia, Cyprus, Ireland (Rep.), Japan, Romania, USA or United Kingdom after having used the visa:

Today inspite of showing emails from the French consulate and from their own airline representative that I don't need a transit visa I wasn't allowed to board. I called up Delta customer service but they didn't budge even though I clearly pointed out what was put on the consulate website. I don't know how they did this but at this point is there any remedy. They did say that I can use my ticket money towards my next flight to India and I can book till Dec 9th with no extra charges. But I have replan all my travel details again and I don't want others to suffer the same fate.
