While it may be against the law, it is common practice that when your first caught you get a warning first, then are arrested the second time. Whilst dangerous, it is not obvious to everyone that you cannot smoke, especially with confusing signals like a no smoking sign right next to an ashtray.
Besides the crew only thought they knew who it was. Unless your caught red handed you cannot blame anyone.

Surely you not drinking and vegan as well? No speeding, no drugs, no fighting, no arrests etc blah blah. Do you have any story to tell your grandsons?

What I don't get is why so many plane bathrooms still have the ash trays in the doors.
