Exclamation Rip Off BofA checking opening bonus

I have been a BofA Amex and MC customer for at least 3 years. I responded to their offer code CH75OL1. I opened an account online.

The initial funding via transfer from another checking account failed, yet there was no notification of the failure.
I proceeded to fund my account via a branch within the required 30 days. I deposited $100 at the branch. Realizing that the requirement was at least $125, I made a deposit of $40 the same day at the ATM of that branch.
The offer states "You must use the Offer Code CH75OL1 and fund your account with the $125 minimum deposit requirement within 30 days in order to qualify for this offer."
I was denied for the promotion. The first rep I spoke to told me that it is a $125 "minimum INITIAL deposit." I called back and requested an escalation. I will hear the answer in 72 hours. They were being very evasive on the actual offer terms. The rep first said that you can only see the offers "as they are being presented on the website." She only offered to escalate after I read out to her that the online page for the offer is phrased differently from their internal offer terms. I believe it is unethical to be able to pull out a different, "internal" set of rules for a particular offer and use that to deny the award. I asked her to mail me the actual terms of the offer in hard copy, but she sounded like she was not going to do that.
BofA seems to have a history of not honoring these types of promotions. I have seen other posters with similar experiences, for example:

To the OP: I think you should fight for your money. B of A is tough to deal with.

Update

An account rep told me today that they will SEND me a check for $75 on 9/9/2010.
I'll keep my fingers crossed.
Note to self: Keeping detailed records is extremely helpful in these types of disputes. I would not have succeeded unless I clearly caught them changing the wording of the promotion to suit their goals.

I had a friend who worked for BoA call center. She thought they treated their employees very well, but treated their customers like crap. Case in point here.

I had the same thing happen to me w Citi, still havent gotten my full miles and money they owe me.

Many of my friends work for BofA (although not involved with credit cards at all) and enjoy it more than other banks. I enjoy not banking with BofA...especially in light of their statement that they will continue charging for other ATMs while many banks are reimbursing ATM fees.

Cool My check arrived!

Hurray! The $75 check came in the mail. I immediately drove to the ATM and deposited it.

I am just disappointed that they would give me such a runaround after being a customer for years. It sounded like such a sincere offer for their credit card holders. Well after the second phone call, during which I made it clear that I meant business and read to the rep the EXACT offer terms that were presented to me, my check was approved. I feel like I won a lawsuit. Having good preparation and evidence is helpful. Still, I thought this was a loyalty offer meant to make you feel all warm and fuzzy about your bank.

Private enterprise is based on the ability of private entities to make contracts and for those contracts to be enforced. BofA essentially is asking customers to enter into a contract, the terms of which are not fully disclosed to the customer. Hence, no matter what you do, they can still say that you didn't meet the criteria for the offer. It's the basis of contract law that both parties have to know the terms. The rep told me that they don't disclose or discuss the terms of the offer via telephone. The terms are only disclosed when the offer is shown online or via mail. They simply can not have a second set of more restrictive offer terms that is not shown to you prior to entering a contract with them. It's really sad that these days laws, rules, and contracts work when used against consumers, but not when a contract is in favor of the consumer.

The piece de resistance, from the letter sent to me:
"Now that you see how easy it is, keep the rewards coming by referring someone else to BofA" !!!!!!!!

I was given an offer code for a much smaller reward for referring others to open a "_qualifying_ personal checking account." Oops, they don't spell out exactly which types of accounts are "qualifying." Why do I get the feeling that if my friend were to open an account, it would not be the one of the account types listed on the sheet of paper they are holding behind their back. Of course, the offer terms can not be reproduced, and they reserve the right to be the sole arbiter. Hence, they get to decide if I followed the offer or not. Well, isn't that convenient for them? The customer gets to enter into a secret contract, the terms of which can not be disclosed to or reproduced by the customer, and the bank gets to be the sole arbiter if these secret terms are followed or not. The customer can not get a clarification of the offer terms if they call the bank, as offers are not discussed on the phone.
