The current CTA decision on the Yangon deal is only for tickets canceled by SWISS Airlines for the seven merged complaints/companions and tickets canceled by Jet Airways for one complainant and companions
- It's not about other carriers because each carrier submits different tariffs.
- If you are not one of the complainants or their companions above who were mentioned in the respective cases, you need to submit a case yourself for hearing.
- There's currently one person who is on Iberia for CTA decision, one can either wait for results or submit a complaint to CTA.
Result of the current case for LX in brief is:
- CTA found 5(F) in the tariff used to be unclear for canceling tickets on erroneously quoted fares.
- 5(F) is unjust and unreasonable and must be revised or taken down by July 9, 2013 (or SWISS can appeal by then)
- SWISS did not use its tariff correctly to cancel the tickets.
- SWISS must compensate one complainant's First Class ticket and any related expenses by July 18, 2013 provided with evidence.
- SWISS must transport other complainants (and their companions) in the original price charged with same booking class and routing by June 18, 2014.
Result of the current case for 9W in brief is:
- Tariff on file had no clauses for "erroneous fares" and was updated subsequently, which means it is not relevant to this event
- Therefore, 9W is to reinstate the tickets with a 1-year validity for transport between the same points and the same booking class.

It looks like A-402-13 will go forward, as CTA's motion to quash the application for judicial review has been dismissed. Additionally, Swiss's motion to stay the Decision was granted.

Got the letter from DAVIS, there are 80 names/cases on it.
So lets assume 1mn in legal fees so far, at 12,500 a case, LX is still spending money like it's going out of fashion.
In the end, they might have to put all of us back on our routes, if things work out, so just imagine the total cost...

I'm confused, how many letters went out today? I got the email from Davis with the request for a continued stay pending the appeal to Governor in Council (the one with 80 names at the end). Is there another one that some people got?

1) Per BrewerSEA, a federal court denied CTA's motion to dismiss A-402-13.
2) The letter from LX to CTA with a list of 80 names at the end, which just asks that the stay of our proceedings (the Feb 12 deadline) be extended, since the appeal to the Governor-in-Council is still pending. This will presumably be granted.

Don't worry about this. Time will work for us. The longer this takes the better so I can push this ticket into 2015 for *G requalification and concentrate on BA Gold this year.

I assume that the 80 names are a total of all who have filed? I was part of the group who received LET-C-A-3-2014 dated January 22, 2014. I have received nothing today.
The current 80 names likely represent more than 80. I was allowed to combine my husband's complaint with mine.

I would probably agree with that. The CTA's decision on the tariff sounds about right.
but the CTA appeared ignore Supreme Court precedent which said an agency may re-open a case if it is in the interests of justice to do so.
it is the second part that will now be allowed.
