[PREM FARE GONE] RGN First class comes back again!!!!

People, please edit/use the wiki so same questions are not always asked.

The current CTA decision on the Yangon deal is only for tickets canceled by SWISS Airlines for the seven merged complaints/companions and tickets canceled by Jet Airways for one complainant and companions
- It's not about other carriers because each carrier submits different tariffs.
- If you are not one of the complainants or their companions above who were mentioned in the respective cases, you need to submit a case yourself for hearing.
- There's currently one person who is on Iberia for CTA decision, one can either wait for results or submit a complaint to CTA.

Result of the current case for LX in brief is:
- CTA found 5(F) in the tariff used to be unclear for canceling tickets on erroneously quoted fares.
- 5(F) is unjust and unreasonable and must be revised or taken down by July 9, 2013 (or SWISS can appeal by then)
- SWISS did not use its tariff correctly to cancel the tickets.
- SWISS must compensate one complainant's First Class ticket and any related expenses by July 18, 2013 provided with evidence.
- SWISS must transport other complainants (and their companions) in the original price charged with same booking class and routing by June 18, 2014.

Result of the current case for 9W in brief is:
- Tariff on file had no clauses for "erroneous fares" and was updated subsequently, which means it is not relevant to this event
- Therefore, 9W is to reinstate the tickets with a 1-year validity for transport between the same points and the same booking class.

If you have a similar case that's with SWISS, you need to file with CTA to get a result through informal process first before it gets to formal process. The entire procedure can take up to 3 months for each and the result may not be same cause it's case-by-base and the reviewer of the case can be different.

Outside of procedural issues, radio silence is our best option.

Indeed LX did dump on various people in ZRH and RGN.

I'm waiting to see how LX will make me whole for what happened to me on these LX tickets.

With respect to the filing of these fares, was (is) that done by IATA or ATPCo? If the latter, what role, if any does IATA have in the filing, calculation etc. of fares?

While I wait in the holding pen with LX, decided to jump into another rodeo and file formal complaints versus the other participants on my other R3s... 5 minutes completing the form and scanning backup material... let's see what happens...

The calculation is done by the GDS that pulls the data from ATPCO is what I would think happens.

This is incorrect. IATA files the fares and ATPCO transmits them to the GDSs and OTAs. Here is a timeline of what IATA claims occurred:
  • 02 May 2012 - IATA suspends Flex Fares from Burma (Myanmar) due to the currency devaluation. (Memorandum 0486)
  • 04 May 2012 - New IROE (IATA Rate of Exchange) for Myanmar Kyat is amended to MMK821.80.
  • 13 July 2012 - Fares are being recalculated to reflect the change to the exchange rate in the country. Fares from Myanmar will be available at a later date. (Memorandum 0489)
  • 23 August 2012 - Attached is a list (Appendix 1) of city pairs where, compared to the current IATA structure, no Flex Fares have been established due to lack of applicable carrier fares for such city pairs. (Memorandum 0491)
    Due to the change to the IROE based on the Myanmar government policy, IATA fares from Myanmar were suspended and taken off system to protect consumer interests and member airline revenue. The fares from Myanmar have been recalculated to incorporate the new IROE for travel on/after 1 September 2012.

Swiss' claim is that IATA instructed ATPCO to reinstate the majority of ex-RGN fares (not tickets, published fares) at a new price level, but excluded first class Flex Fares RGN-YMQ because of the lack of equivalent carrier fares upon which to base the price.

Some people say wait so you can see what happens to those in front. Others say go so that if/when a decision comes down you are in front of the crowd before any subsequent decisions, reversals, etc.

The first group of 23 (ish?) seems less desirable now than before with one person unable to just wait it out. I agree, silence is preferred.

Read again. This was addressed to the CTA and not to the complainants (who were only in the CC).

Slightly OT

I just read in Travel Pulse that there were three bombs that exploded yesterday around Burma. One was in the lobby of Traders Hotel where I stayed in Feb. An American was injured. So sad. The hotel was so great and all the people I met I. Burma were wonderful. I am so glad I had the experience.
