Continental Airlines Receives Final DOT Approval to Join Antitrust Immunized Alliance With United, Star Carriers
WASHINGTON, July 10 /PRNewswire-FirstCall/ -- The U.S. Department of Transportation (DOT) today approved the application for Continental Airlines (NYSE: CAL) to join the existing antitrust immunized alliance including United Airlines and eight other Star Alliance member carriers.

5th largest airline? Wasn't CO 4th largest? What's the ordering now?

I think CO dropped a spot with the consolidation of Northwelta. Can't remember exactly.

The DOT applied carve-outs to the following routes such that antitrust immunity will not apply unless further competitors enter the specific markets:

I guess for the Canadian routes they're preparing for the possibility that one of the LCCs will try to fly them.

What does that mean for AC and CO, on say the Houston to Calgary route, exactly? No codeshares or connections or what?

This would be different than CO LH on Houston to Frankfurt?

Glad to see the DoT making the right move here for CO. Absolutely no reason for the immunity not to have been given.

Hmmmm, exclusions for Calgary? Too much oil money to be left on the table by codesharing and playing nice??

And Toronto is the largest originator of passenger traffic from Canadia into the USA. That might have something to do with that exclusion.

The TATL carve-outs actually make a ton of sense. Who else but *A members would make for serious competition on what are essentially Star Alliance hub-hub routes?

Hm... Except for the IAD-FRA route, which strangely will be granted immunity after the alliance entry (?). JFK has DL and AA, ORD has AA. DL and AA can start flying to any of these destinations to create competition and can make them work.

YYC and YYZ are a different story, though Chicago-Toronto definitely has competition from AA and Porter.

Think these carve-outs show a short sightedness on the part of the DOT. Is there any competition on these routes anyways?

I guess it depends how you measure size. If you select number of passengers, then Southwest just surpassed American; however, the new Delta is now bigger than LUV. CO is about seventh or eighth. If you base the assessment on equipment or fleet size, which I think is also pretty reasonable, then CO is number six (DL is the largest, then AA followed by Air France/KLM then WN). CAL is certainly the fifth largest in the US; if you look at Air France and KLM as two separate entities, then CAL becomes number five.
