Jeff, I agree with you.
The point I was trying to make is thas as long as Continental plays by the rules they set, then you have a right to complain.
If you don't get an upgrade, well sometimes thats the luck of the draw, no entitlement.
However, in a case where Continental breaks it's own rules, then you have a right to complain.

One is entitled to an upgrade, if space is available, based on the rules of the program. Space available doesn't negate entitlement, it just qualifies it.
