I think there is a vast difference between the two major party candidates on this issue and that one is more likely than the other to appoint justices that are pro-civil liberties.
And also, although I am not a fan of his, best wishes to Chief Justice Rehnquist for a speedy and full recovery.

I live in a swing state* now, and although I voted for GWB in 2000, I've become increasingly concerned about our liberties and freedoms over the past few years. I've wrestled with whether it's worth "throwing my vote away" to vote for Badnarik out of protest, to the point where I issued a plea on OMNI a few months back asking those present to justify my voting for Bush again.
I've come to the conclusion that a vote for the LP is not only necessary at this stage, but is worth a possible four years of Kerry as President. In fact - given what the Republican executive branch has "accomplished" since 2001 - a Kerry presidency might be a beneficial side effect of my "wasted" vote.

I'm not suggesting anything about the President and whether he would or would not raise the silly alert level for political gain. (This isn't an OMNI political discussion, you know.)
What I am saying is that this gives us some empirical evidence that fear can be used by an administration for political gain. Something to consider when choosing an administration.
