Yes, you can activate the iPhone, without the phone part, for use as a better iPod. You need two pieces of software, and it takes about three minutes. You may as well invest another five minutes to do the unlock and wind up with a phone as well, though. It's not like it costs anything.
There is no way for Apple to deactivate it, or unlock it. Once it's done, it's done. Apple may (and probably will) release updates to the firmware that relock it, but there's nothing making you install those - it's always optional. I have unlocked four of them now, and they work great.
