Downgraded without a refund..

Interesting story here from msnbc about a passengers downgrade experience with Virgin.

Seems to have been quite badly handled.

Aren't downgrades covered under EU rules? ISTR comp for downgrades is set out - shame both VS and Christopher Elliot don't seem to know that - he was entitled to a portion of the ticket price back

I agree he was very shoddily treated. After being forced to endure a flight on BA; he should have got all his money back and comp miles, to make up for the inevitable loss of his luggage.

Lets hope he opens a BAEC account and claims the BA miles as well.

The article mentions that the flight was cancelled and this was an offered re-routing presumably complying with Article 8 of EC 261/2004.

It doesnt canvass any proferred reason for the cancellation or the timeliness of the re-routing to see whether Art 7 would come onto play.

It doesnt consider whether the downgrading provision within EC 261/2004 would apply to a downgrade within the context of a re-routing. (Although looking at the wording EC 261/2004 it may well do).

Most of all its doesnt consider whether any downgrade "reimbusement" awardeable under EC 261/2004 should be made in addition or as an alternative to the contractual recompense to the passenger for not providing the flight in the fare class for which the ticket was originally bought.

No wonder there is so much confusion in this area on the part of passengers when the self-proclaimed "journo-experts" are themselves so clueless.
