Had a weird denial come through for my wife.
She's a Green Card holder, with no previous immigration or customs concerns. No criminal history. Travel is mostly between the US and her home country for a couple months at a time. She was conditionally approved after many months, did the interview on arrival at SFO, and all seemed good. Logged in today and her GE was denied! Obviously will write to the Ombudsman, but never expected such an opaque denial. We regret to inform you that your membership in Global Entry has been disapproved for the following reason(s): Other You do not meet TTP strict standards. |
Have a look at my post above - it sounds like CBP have not yet implemented the GAO recommendation about signposting recourse and additional information? The full GAO report (a link from the blog I mentioned there) with more info is at: https://www.gao.gov/assets/d24106314.pdf

But this must be expected if they're taking months and months to conditionally approve? |
Okay - so I finally got an update for my mom's GE application after about 11 months of waiting. Apparently she was denied because she accidentally misselected her gender on the GE application form. Is there a way to request CBP to correct and reconsider? There is no "appeal" or "reconsider" option in the TTP portal. Anyone have any ideas on how to appeal? Does she have to submit a new application or is there still hope to talk to the CBP Ombudsman? Is there a way to reach the Ombudsman if there's no recourse or reconsider option in the TTP portal?

Renewal question
I've read differing posts on here about whether to include countries that you've transited en route to your final destination EG ATL-IST-TBS.
When renewing would you list IST if you only transited the airport? Thank you |

Did you check the Global Entry Application Countries Visited [consolidated thread]?

Hi all, hoping I can get some help as it's been very hard to figure out what needs to be done. I have read the thread and learned a lot but have a few more questions on the process...
Long story short, I am a canadian citizen on a student visa who did undergrad and now a phd program in the US. Still currently on an F1 student visa. 5 years ago I was arrested for a felony charge but it was dismissed and the arrest record was subsequently expunged. Since then, every time I come back into the country I am sent to secondary inspection where I sit around for about an hour until they just tell me I am good to go, on their end they dont see anything but a failed NICS check. The last time the CBP supervisor suggested that I apply for NEXUS in the hopes that it would speed it along. I did so 2 years ago and never heard back so I filed for a DHS TRIP redress number last week which told me this:After careful review, we have determined that your NEXUS program application was denied because you do not meet the guidelines for program participation. An individual is ineligible to participate in the Trusted Traveler Programs if CBP, at its sole discretion, determines that the individual presents a potential risk for terrorism, criminality, violating customs, agriculture and/or immigration laws, or is otherwise not a low-risk traveler. This risk determination will be based in part on an applicant's ability to demonstrate past compliance with laws, regulations, and policies. Reasons why an applicant may not qualify for participation include, but is not limited to: The applicant provides false or incomplete information on the application; The applicant has been arrested for, or convicted of, any criminal offense or has denied firearms transactions, pending criminal charges, protection orders, or outstanding warrants in any country; The applicant has been found in violation of any customs, immigration, or agriculture regulations, procedures, or laws in any country; The applicant is the subject of an investigation by any federal, state, or local law enforcement agency in any country; The applicant is inadmissible to the United States under applicable immigration laws or has, at any time, been granted a waiver of inadmissibility or parole; The applicant is known or suspected of being or having been engaged in conduct constituting, in preparation for, in aid of, or related to terrorism; or The applicant cannot satisfy CBP of his or her low-risk status or meet other program requirements. Obviously this previous NICS failure is what is showing up on their end and holding me up. I did get a redress number issued though. My question is, as this charge was dismissed and the arrest record expunged surely there should be a way for me to appeal the denial? I saw mentions of a Privacy Act/FOIA request procedure to find the exact reason for denial but does anyone have a template they can share for said FOIA as well as an email? I would then want to appeal the NEXUS program denial with the Obumdsman once I know for certain that this arrest record is what is holding me back. Thank you. |

The appeal to the Ombudsman has come back, stating: A review of your membership by the CBP Ombudsman has been completed. Based on the information you provided, it has been determined that no change is warranted at this time. Please be mindful that being denied from participating in the Global Entry program does not prohibit you from being able to travel. If you do not know why you were denied, then you will need to submit a request for personal records to the CBP/Freedom of Information Act (FOIA) Division, in accordance with federal privacy laws. Also filed an inquiry with the DHS TRIP program due to the denial and increase of secondary referrals for my wife. I doubt there is anything we can do, except wait for the [likely redacted] FOIA request to be processed. |
Just got notice that my Nexus and GE were revoked. Have had GE for 7 years and Nexus for about a year. Just crossed the border last night from canada with a location that has pre-clearance. I used the kiosks which provided no problems. Walked up to the officer who asked me to look into the camera and asked a few questions… which is unusual since it’s usually an automatic clear. I declared the two bottles of alcohol which the officer even made a joke about “got anything good?” and waived me through.

A single individual cannot hold Nexus and Global Entry at the same time. A new Nexus membership replaces your Global Entry membership.

I'm at a loss and can use your advice... Approx 3 years ago, my NEXUS approval was revoked while I was home (had not used NEXUS in the past 2 years). No reason given other than "other" prior Customs or Agriculture violation(s). I so rarely travel to Canada any longer, so I decided to apply for Global Entry instead. That application took a year to review and just yesterday I was denied for the same reason. I have absolutely no idea what the issue is. I've never had any incident at the border with customs or agriculture. I'll request reconsideration, and my plan is to just state what I have told you all. Is there anything else I should include? They only allow a few sentences to explain.
Thanks! |
