No, just appeal to the ombudsman for a review.

I would do a FOIA request to see what they have on you first. Without more context, appealing by simplying stating "I haven't done anything" when their records likely show otherwise isn't going to help, even if those records are wrong.

I have done that. Thank you. Not sure how long those are taking but I'm assuming it will be several months?

Where to submit TTP FOIA requests?

The appeal to the Ombudsman has come back, stating:

Not entirely helpful. Submitted the subsequent FOIA/Privacy Act requests to CBP, but don't expect helpful information to be returned.
Also filed an inquiry with the DHS TRIP program due to the denial and increase of secondary referrals for my wife.

I doubt there is anything we can do, except wait for the [likely redacted] FOIA request to be processed.

Can you tell me how you submitted your FOIA request. On CBP's site is says to submit FOIA requests for TTP to the enrolment centre, but they would not provide any information in person and there is no place to send it specifically. Did you just do through the general CBP site?

Global Entry approval after previous denial(s)

I would like to share my experience with the CBP Trusted Traveler programs for the past 12 years.

I got my LPR status in the US in 2013, after living in the US on an expired visa (overstay) for the previous 18 years (same-sex relationship with US citizen, not allowed to apply for LPR until 2013). I immediately applied for NEXUS and went to Vancouver, BC, for the interview. I talked with an US officer first and everything was fine. Then he sent me to talk to a Canadian officer and she was really irritated about my visa overstay in the US. I was denied a NEXUS card.

A couple of weeks later, I applied for Global Entry, got conditionally approved, and to the interview I went. The officer was very nice. I explained my situation to him and he said I should be fine. Eight days later, I got a DENIAL letter. In 2015 I decided to appeal that decision to the CBP OMBUDSMAN and after about a year I got a DENIAL letter.

I applied for Global Entry again in 2017, after becoming a US citizen, and was DENIED without an interview.

I decided to try again in 2021. My application was conditionally approved. I got interviewed by an officer who didn’t know much about US immigration laws. She said she had a family member with a similar immigration case as mine, and told me I should have done this or that back in the 90s. She kept calling me a criminal for overstaying my visa. I asked her to stop doing that because it’s not a crime to overstay a visa, it’s an immigration offense. And she should know that. I was about to ask to talk to her supervisor, but she then stopped calling me a criminal. DENIED once again.

March 10th, 2025 came. I saw an article about Global Entry and then I decided to do a Google search for GE approval after immigration violations. This person in a forum said that CBP might approve you if 10+ years have passed since your violation. I got excited and reapplied, but I regretted doing so, on the next day. I was hoping to be denied right away. If not, I was not going to attend an interview.

Forwarding to August 12th, 2025. I was conditionally approved. But I didn’t really want to go talk to an officer in person, just to be denied again. I logged in to my account and clicked on the “Schedule Interview” button, anyway. To my surprise, there was an option for an online interview via ZOOM. I later learned from the web that if CBP already has your photo (less than 10 years old) and fingerprints on file, then you don’t need to see them in person. Great, I thought. I can talk to them and if they are rude again, I just hang up. I scheduled the interview for the next day at 2pm. They had 252 slots available on that date.

During the interview, the officer:

-Asked me to show him my Passport and Driver License in front of the camera;

-Asked if I had committed any crimes or been arrested;

-Inquired about my work;

-Inquired about my trips: made a comment that I travel a lot, and asked why and for how long I went to Egypt, Jordan, and Turkey;

-Told me my GE card would arrive in the mail in 2-4 weeks;

-Asked if I had any questions. I wanted to know about using the GE card on a NEXUS lane coming from Canada on a rental car rented in the US. He told me the car needed to be registered with CBP, but later I learned that is not true.

The whole interview lasted less than 3 minutes. It started at 2:00PM and at 2:03PM I was already telling my husband the good news. I received an email from CBP just a minute later. I checked my account, and GE was approved.

I was in impressed about how easy and quick this interview was, unlike the previous ones. There were no questions about my past immigration violation, even though I mentioned it in the application.

And that’s my 12-year saga with the CBP Trusted Traveler programs.
