You are correct. I pretend I don't see the ridiculous (and fraudulent) minimum charge requirement and order the food anyways. When it comes time to pay, the card comes out. They remind me of the minimum charge requirement, I remind them that all I have is plastic (I always carry cash but hide it at this point), and that their window decal says that they accept the CC in question. At that point they can take the food back (which in most cases they won't), or I walk out and go elsewhere. In most cases the place concedes and I get to use plastic, although I won't come back because they'll probably spit in my food.
