Using Unauthorized Codes- Risks

I've always wondered what happens on these "improper" rate codes when there is an accident. Maybe it's just because people don't talk about it but there is a huge amount of it being done to never have any incidents. I do read constantly of humiliation when a rate is denied at the pickup location, so it is discussed.

I had a car out on state rate and it was in a small accident while a designated driver was driving. My insurance asked some questions but seems to be covering liability as a covered guest driver on a "replacement" vehicle. It's been 5 months and the rental company hasn't said anything about collision damage. (The rate includes collision and liability).

As a lawyer I wonder if the likely recourse a court would impose in case of the rate being unauthorized, would be imposing "rack" rate for the rental and coverage instead of invalidating the whole thing. Courts are loathe to kill insurance coverage. Fortunately I've got my insurance, the rental company's, and my credit card's primary for collision. (Also, fortunately, it's not a huge amount.)

From this I can recommend always having an "easy" insurance company and also being prepared to at least say it is a replacement as your own car is acting up, etc. I wasn't asked for proof of that(yet). I was initially told a guest driver was not covered for liability on a replacement but they seemed to have changed their tune. A replacement should have the same coverage as your main car.

Anyway, nothing has been paid or settled yet so it's an on-going story. I'll update.
