Cant the ACLU help us?

So I jump on the Metro this morning from ChinaTown to Regan National.

I have my coffee in hand and a bottle of water in my laptop bag.

I assume I am not the only one with water in my car. In fact there are probably countless containers of gels and other liquids onboard.

I look around and realize that TSA or DHS has no idea who is commuting on the Metro.

Why the hell do I have to pitch my water at the airport?

Either transportation is safe or its not.

While I appreciate the sentiment that DHS/TSA have gone overboard at airports, aren't beverages still banned on the Metro in DC or was it just food that landed passengers in trouble?

The following are some rules and manners when riding Metro.

Please don't eat, drink, smoke or litter on Metro vehicles or in the stations. Metro Transit Police issue citations or make arrests to enforce the law. Help to keep the system clean.
Says bus rules on the link, but the material within seems to indicate that it applies to Metro (rail) as well.

Unfortunately the Constitution does not prohibit the government from banning water on commercial flights. The Constitution does allow Congress to pass laws for the general welfare; however it does not require such. It would be nice if Congress would tell the TSA to take its dehydration experiments and stuff it but they won't because too many people are idiots and clamor for ever-increasing "security".

It's not a total loss, though -- for example, the recent court ruling striking down the government's warrantless wiretapping program.

Yes, but the rules have nothing to do with terrorism! They just want to keep the darn cars clean.

You know the state is appealing this to a circuit court that's nice to republicans, right?

Go molest some children or try to rip a cross off of a veterans memorial. The ACLU will be at your side in no time.

The DC Metro police actually have a history of jack-booted thuggery and overreaction when it comes to passengers eating/drinking.

http://www.flyertalk.com/forum/showthread.php?t=348331

As much as I dislike this idiotic anti-food/anti-drink policy (instead of a more sane anti-slob policy), it is not nearly as bad as TSA's stupidity. The DC Metro doesn't forbid possession of food drinks in your bags, just consumption.

When the train gets stuck on a bridge in the sun for hours and hours, I'll have no qualms about pulling out my water bottle. But when a plane gets stuck on the tarmac in a multi-hour ground hold, TSA wants me to be thirsty.
