PAPD as Authority

And, based on the federal regulation you cite, it would appear that the TSA and the airlines have agreed that the PAPD will simultanteously check the firearm and validate the law enforcement officer's credentials at the Port's airports.

Sorry, Havent checked this in a while.

Yes, I am a full time, fully compensated, sworn police officer.

Yes, I identified myself to the first PAPD officer that came to the call of the TSA supervisor, woefully uninformed and misguided as she was.

The PAPD officer said that he tried to read the new law but it was very confusing.

Sheesh. Luckily another PAPD officer came by and let him know that this was actually a law passed the year prior.

Thank you for your letter concerning your experience while traveling
through John F. Kennedy International Airport (JFK). We are sorry that
you were unhappy with your recent travel experience and hope the
following information will be helpful.

We appreciate that you complied with all the regulations of the Airlines
as well as the FAA, however, based on the information you have provided
the Transportation Security Officer followed our Standard Operation
Procedures. It is procedure when a gun is recognized (even if there is
no alarm) the bag must be opened to determine if the gun has been
declared and secured. It is also SOP for an Officer to be called.

Your second concern referred to your 4th amendment right being violated.
Although it may not be common knowledge when you turn your luggage over to the Airlines for transport or when you pass through the Federal
Screening Checkpoint, Federal Law dictates that it is implied consent
for search of your person as well as your belongings. You can deny this
search, however, you would not be permitted to travel.

Once again I apologize for any discomfort you or your wife experienced.

If I can be of any further assistance please do not hesitate to contact
me.

Best Regards,

Judy Finkelstein
