That's a good suggestion, and I'd suggest pursuing that course in a way that creates a "paper trail" of sorts.

My faith in my own government and all other governments is such that ordinary citizens -- minorities more so -- should do what they can lawfully do for their and their own near and dear one's own protection against government (employee-enabled) efforts to undermine the legitimacy of such person's status/actions. This includes creating secured, distributed record trails for self and progeny. Governments are neither friends nor saints for the common person -- so make sure to not believe or act as if they are and will be going forward. With electronic records, even literal paper/plastic trails being maintained is essential to strengthen one's position for response.

Can you secure a photo/photocopy/digital copy of yourself in an elementary or middle school class photo with a substantial or predominantly European-American classmate group at such school?

Do you happen to have access to your parents' current/expired passports? A copy of such along with your birth certificate copy mentioning their names and a personal statement (in person, if possible) or something else documenting their connection to you could be useful.

About the baptism record inquiry line, did she ask you for your family Bible as well?

my dad never travels and my mom just recently got her passport because her and my sister took my grandparents on a cruise what im going to do is fill out this form for my local representative of my county and take it or fax it to his office maybe that will help im also about to call the hospital i was born in and try get some paperwork from them as well

hah this is complete bs i called the hospital i was born in brooklyn ny and they only keep records for 21 years

The New York State Department of Vital Records has what you need to prove the person with the name at the time of birth was a US citizen at birth, unless for some reason the USG has some indication that one and/or both of the parents, as named on the certified copy from NYS Health Department's Vital Records Section, was not subject to US jurisdiction at the time of your birth.

You are being hassled for either one or all of the following pursuits: (1) proof of citizenship; and/or (2) proof of identity; and/or (3) you have been blacklisted from getting a US passport or otherwise blacklisted. It's important to find out the relevance of the above three to your situation.

That's a great suggestion. I'd also suggest that you start a search for a good attorney experienced in passport and immigration matters. There are some around. At the very least retaining an attorney experienced at dealing with the agency will get their attention at a higher level than the clerks you're dealing with.

It's entirely possible that you have been added to some kind of watch list, especially if your other family members have not had an issue. You DO need to get it straightened out as many states (under the threat of RealID) have raised the bar on proof of citizenship. I had a real problem when I moved back to Virginia as there was some kind of mismatch in the DMV records possibly related to identity theft. 4 visits to DMV and 3 weeks to get it resolved. And I was born in Virginia....

OP, have you at anytime changed a name? Even a middle name? Does your old driver's license list the exact name you are using now? Ever used a middle name as a first name?

I've done a little googling of Vitalcheck and none of it is good. A lot of reviews are of people getting the incorrect documents back, misspelled names or incorrect information on the documents that they requested. It's hard to say because you said you didn't really look at what you got back from Vitalcheck. You said you were born in New York, contack the dept of vital statistics for New York directly and request another birth certificate. Make sure all the information on there is correct.

Just trying to cover all the bases here. I agree on getting in touch with a representative for your district. They might be able to at least find an answer for you.

Not sending "filed without further action" letters is distinct from having -- for intra-Department/intra-USG/intergovernmental purposes -- a"file[] without further action" functional equivalent outcome (i.e. for the government).

In short, presumed yes, unless and until I try to get back on that here.

well i have an appointment with an immigration attorney monday who sounds like he can help me and he sounded pretty pissed off that they are making me do all these things so hes not charging me for the first visit and he said if anything he can help me put together a packet to send to the passport agency. i went to my local district representative's office earlier today they werent much help they told me to goto the local passport office which isnt an official passport office but a rush passport office when i called them they said they couldnt help me unless i filed my passport app through them

It sounds like you are headed in the right direction; hopefully he can help you.

By the way, the ACLU sued the DoS over conduct similar to what you describe-- repeated requests for additional documentation, stalling, threatening to close applications if more documents are not sent and closing applications as "filed without further action"-- but the DoS's motivation was much clearer in that case than it is here.

well i got some great news today i requested help from a local senator faxed over a privacy notice with a letter explaining whats going on we spoke on the phone earlier this morning well i just got a call from him saying he got word back from the passport office that they have everything they needed and they should be mailing off the passport before the end of the week he told me if i dont receive it by the middle of next week to call or email him again and he will make another congressional inquiry for me i'll keep my fingers crossed

yea this is the email the congressional aid got back from the passport office i tried calling at 4:30 but they didnt have a tracking number yet i will call again tomorrow morning i Xed the name out of the aid who helped me ill breath easier when i have a tracking number so i know its coming
