Yep, that would most likely be F2, student dependent.

Note to OP: If I were you, I would either attempt to discharge my responsibilities with regard to the DWI, or not visit the US altogether. There are so many great places you could go. Why go somewhere where you could end up in jail for an undetermined amount of time?

And, no need to lecture me on what LPR is. I was one for 5 years.

Did it occur to you that he may have been a dependent of an LPR and thus an LPR himself, even though he did not personally acquire the Green Card?

I know someone who was in a situations like yours, albeit before the ESTA program, and they were ok, he was actually a tourist when his problems happened. just don't go to the state you are wanted in, they won't extradite you for a misdemeanor, and at customs if they bring it up just tell them your heading to the city your wanted to clear up the matter.

I'm not sure if you will be allowed back tho, he's come back a few times and he still has an outstanding warrant.

FYI, I Would recommend not lying to CBP. If you are not really going to the state the warrant is from, things may not go over well.

I would recommend avoiding arrival in the jurisdiction (state) in which the DUI occurred and the bench warrant issued.
