NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Entry Period: The "Laguna Beach Surf Into Summer Sweepstakes" (the "Sweepstakes") commences at 12:00 a.m. (EST) on August 9, 2005 and ends at 11:59 p.m. on August 29, 2005 (the "Sweepstakes Period").
2. Eligibility: The Sweepstakes is open to legal residents of the continental United States, who are at least 18 years of age at time of entry. VOID IN HAWAII, ALASKA AND WHEREVER PROHIBITED OR RESTRICTED BY LAW. Employees (and the members of their households or immediate families (i.e., their spouses, parents, siblings and children and each of their respective spouses) of Viacom International Inc. ("Viacom"), MTV Networks ("MTVN"), MTS, INC. dba Tower Records ("Tower Records") (MTVN and Tower Records, collectively, the "Sponsors") and each of their respective corporate parents, subsidiaries and affiliated companies and entities, including their divisions, and advertising agencies, and anyone who has won an MTVN Contest or Sweepstakes in the 2005 calendar year, are not eligible. By participating in this Sweepstakes, entrants acknowledge compliance with these official rules ("Official Rules) and agree to be bound by them, by Sponsors interpretation of them and by the decisions of Sponsors, which are final in all matters relating to this Sweepstakes.
3. To Enter: There are three ways to enter. Limit one entry per person or email address regardless of method of entry. To enter online, visit towerrecords.com and complete the online entry form during the Sweepstakes Period. Online Entries must be received by 11:59 p.m. (EST) on August 29, 2005. To enter at participating Tower Records stores, complete an official entry form (available at participating Tower Records stores) and deposit your entry in the receptacle located in the store during the Sweepstakes Period. In-store entries must be received by close of business on August 29, 2005. To enter by mail, hand print your name, address, city, state, zip code, area codes, phone number and e-mail address (if any) and mail it in a pre-paid, pre-addressed postcard to LAGUNA BEACH SURF INTO SUMMER SWEEPSTAKES, c/o Tower Marketing, 2500 Del Monte Street, West Sacramento, CA 95691. Mail-in entries must be postmarked by August 29, 2005 and received by September 5, 2005. Sponsors are not responsible for late, lost, misdirected, illegible, corrupted, delayed, mutilated, incomplete or postage-due entries or mail; or for computer system, phone line, hardware, software or program malfunctions; or for other errors, failures or delays in computer transmissions or network connections whether human or technical in nature. All entries must be filled out completely with name, address, city, state, zip code, area code, phone number and email address (if any), and must be submitted as instructed. No facsimiles, photocopies or mechanically reproduced entries are permitted. Online entries must have a valid e-mail address. In the event of a dispute concerning the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail account as of date of entry. An "authorized account holder" is defined as the natural person who is assigned to an email address by a telephone company, wireless service provider, Internet access provider, Internet service provider, or other organization (e.g. business, educational, government, institution, etc.) that is responsible for assigning email addresses. Any effort by an online entrant to misrepresent himself or herself through the use of aliases or multiple e-mail addresses will disqualify all entries of that entrant. All mass entries or entries generated by a script, macro or use of automated devices will be disqualified. All entries become the property of Sponsors and will not be returned. Entries submitted in accordance with those Official Rules shall be hereinafter referred to as the "Eligible Entries."
4. Winner Selection and Notification: One grand prize winner (the "Grand Prize Winner") will be selected in a random drawing on or about September 6, 2005 from among all Eligible Entries received and will be notified by telephone. Sponsors will make a minimum of two (2) attempts to contact the potential Grand Prize Winner during the forty-eight (48) hour period following selection of the potential Grand Prize Winner. If the potential Grand Prize Winner cannot be reached during the forty-eight (48) hours during which Sponsors attempt to contact the potential Grand Prize Winner (no messages will be left on answering machines or voicemail systems), such potential Grand Prize Winner will be disqualified and an alternate Grand Prize Winner will be selected from among all of the remaining Eligible Entries received in Sponsors' sole discretion. The odds of winning depend upon the number of Eligible Entries received.
5. Prize: One (1) Grand Prize (the "Grand Prize") will be awarded, consisting of a trip including: (a) roundtrip coach air transportation for Grand Prize Winner and one (1) guest (the "Guest") from an airport of MTVN's choice near Grand Prize Winner's residence to Cabo San Lucas, Mexico (the "Destination City"); (b) hotel accommodations for Grand Prize Winner and Guest for a total of three (3) nights in Destination City (costs for room and tax only based on one room with double occupancy; meals, telephone calls and other incidentals are not included); (c) roundtrip airport transfers while in Destination City to and from the hotel; (d) a MTV Laguna Beach surfboard. Travel must take place between the dates of January 6, 2006 and December 31, 2005. Blackout dates may apply. If Grand Prize Winner is not available to travel as determined in MTVN's sole discretion, then all privileges as a Grand Prize Winner will immediately be terminated. The total approximate retail value (the "ARV") of the Grand Prize package is $5,000. No substitution, transfer of the Grand Prize (or any portion thereof) or cash alternative permitted, except by MTVN, due to prize unavailability at time of award or circumstances beyond MTVN's control, in which case a prize of equal or greater value will be awarded. The ARV for the Grand Prize is subject to change based on current market conditions at time of the prize fulfillment.
6. Grand Prize Winner Verification: As a condition of receiving the Grand Prize, the Grand Prize Winner (or his/her parent or legal guardian if the winner is a minor in his/her jurisdiction of primary residence) must sign and return, within forty-eight (48) hours of receipt, (i) an affidavit of eligibility and liability release and hold harmless MTVN, Viacom, MTS, INC. dba Tower Records and their respective corporate parents, subsidiaries, affiliated companies and entities, including their divisions and advertising agencies, and the officers, shareholders, directors, employees, agents and representatives of each of them from and against any and all liability, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Sweepstakes or the use or acceptance of the Grand Prize, and (ii) except where prohibited, a promotional release granting the right to use his or her name, likeness, voice, and all entry materials for advertising, publicity and other commercial purposes, without additional compensation. Entry into this Sweepstakes constitutes Grand Prize Winner's agreement to sign such releases. Grand Prize Winner must also complete any additional legal documents provided by Sponsors with respect to the Grand Prize and return them as instructed within seven (7) days after receipt of such documents. Noncompliance may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY GRAND PRIZE WINNER (AT MTVN's SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS A GRAND PRIZE WINNER OF PARAMOUNT LAGUNA BEACH SURF INTO SUMMER SWEEPSTAKES" AND ALL ASSOCIATED PRIVILEGES WILL BE IMMEDIATELY TERMINATED. IN SUCH EVENT, AN ALTERNATE WINNER MAY BE SELECTED IN A RANDOM DRAWING FROM AMONG ALL OF THE REMAINING ELIGIBLE ENTRIES RECEIVED IN MTVN's SOLE DISCRETION. Upon receipt of the Grand Prize, Grand Prize Winner is required to comply with any and all applicable federal, state and local laws, rules and regulations. General Terms: Sponsors assume no responsibility for incorrect or inaccurate entry information whether caused by a participant or by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error which may occur in the processing of the entries in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that their judgment corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsors reserve the right in their sole and unequivocal discretion to cancel, terminate, modify or suspend the Sweepstakes and/or prizes. In such event, MTVN may award the Grand Prize by a random drawing from among all remaining Eligible Entries received prior to the action so taken. Entries that have been tampered with or altered are void. Sponsors reserve the right, in their sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web site; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
