There is a sixty minute cutoff for checkin for international flights at CO; a rule that I believe is imposed by the FAA due to security reasons and checking everyone on the flight against watch lists and other things.

It is not CO's fault that he couldn't get on the flight. It is CO's fault that the employees didn't care, but then again, we all know how nice EWR staff can be.
