Amex Gift Card Surcharges
Does anyone know if merchants can legally surcharge purchases on Amex prepaid gift cards? If not, please cite the law or regulation.

Amex gift cards are like Amex credit cards to merchants. Law and regulation in which jurisdiction? Rules and regulations on this vary widely.

Have you encountered a merchant that surcharges a prepaid Amex (but not other Amex) cards?

Visa & Mastercard merchant agreements do not allow for surcharging debit & prepaid card purchases (except for a flat convenience fee). I was looking for any such distinction within Amex.
