Yes, that would be a scam ... and it does happen way too frequently outside of airports and good establishments. However, the bottles of water sold airside at airports and given in the lounges rarely have plastic seals on them and yet I've never been with someone who's gotten sick that way.
.... or maybe someone has and we've just gotten lucky repeatedly.
