In theory the onus is on the airline to pay up, not on the passenget to chase matters. However, as with many things that come out of the EU, this doesn't appear to have been thought out properly.
It was designed to guard against overbooking on flights but when you get mechanical problems the airline claims it was outside their responsibility, but I believe the EU doesn't. Talk on the BA board suggests airlines aren't playing ball at all on this one.
