The default position is now that flights booked under an AA, BA or IB code will earn revenue-based Avios if credited to BAEC. The booking class or operating airline are both irrelevant in this respect.
Some tickets will still earn distance-based Avios, e.g. BA Holidays bookings. Generally these are ones where the fare is not displayed to the passenger when booking or where it's a non-public fare.
I would be very surprised if BA were doing this in breach of GDPR. There will no doubt be a "safe harbour" type agreement that makes the data transfer lawful, otherwise you couldn't book any AA flights as a UK/EU citizen/resident for example.
