I mean, neither a Gold nor a Silver is particularly likely to be upgraded on most routes, so you're really talking about who gets 'bragging rights' to be ahead of the other at #15 on the list.
That said -- and assuming this is a Complimentary Premier Upgrade route -- in the first scenario, the Gold member has priority. In the second scenario, the member on a paid fare has priority.
