I'm pretty sure this was always the case from the time when the 3-hour rule was announced, although the stand-by exception wasn't in the original email release but I think it was in the FAQ pretty early on (where it still resides).
Yes, you should have reminded them. Presumably the nuances of the new policy will take a little time to be fully embedded with the agents.
