In a similar situation today-- luggage found, evidently forwarded to MEX, lost again at MEX (*by the "delivery company*).
In this situation, we are fully prepared to argue in front of a US Court that the second loss is not covered by Convention (it is not a loss during the carriage, rather, due to negligence during further transit) and strict liability for contents + associated damages, costs & fees should apply.
