Would you cancel it first and dispute with DOT then? OR, not cancel and dispute on the fact that UA is refusing to refund? Not sure of the order here.

I think the law is clearly on the side of the passenger in this case. I suggest that you file a DOT complaint and see report back what happens. It only takes about ten minutes.
