I agree. It seems US law enforcement is pretty trigger happy about labeling and prosecuting "fraud" when corporations are affected, and do nothing when corporations abuse consumers with arbitrary actions such as devaluations, shutting down people's accounts and taking away their points under arbitrary "any time, any reason, at our own discretion" terms.
Also, the related Flyertalk news article headline is pretty biased. It says the guy "stole" the points:
